Hallo zusammen,
ein im EU Ausland ansässiges Bekleidungsunternehmen (2,2 Mrd EUR Umsatz im Jahr) hat eines meiner Fotos unerlaubt auf T-Shirts abgedruckt und verkauft. Durch einen aufmerksamen Abonnenten meiner social media Channels bin ich erst darauf aufmerksam geworden.
Ich verkaufe meine Fotos über einige Stock Agenturen, konnte jedoch keinen Verkauf dieses Fotos mit erweiterter Lizenz finden, die für den Druck auf Handelswaren nötig gewesen wäre.
Ich erkundigte mich, wo sie denn das Foto lizenziert hätten und bekam folgende Antwort:
Dear Nils,
My name is xxx and I am a xxx at xxx.
I received an information from our Customer Service Team regarding the model of t-shirt with your photo used (https://xxx).
I am very sorry for this situation and would like to inform you that we always make sure that the commercial use of graphics and photos is always in accordance with the law and rules and with respect for authors’ copyrights.
This is a one-off and exceptional situation that should not happen. I contacted with the Product Manager to clarify this situation. Our new graphic designer who designed the t-shirt did not know that she should buy the license right in the moment the model was agreed to be produced and sold. She was planning to buy it at the end of the season. In this particular situation, it was the human factor that failed.
I wanted to confirm that I made sure that the license was already purchased today. You can also check it on GettyImages site where we found your photo.

Eine Rechtsschutzversicherung habe ich leider (noch) nicht, werde aber, falls nötig, einen Anwalt einschalten. Lieber wäre mir natürlich, die Situation ohne Rechtsbeistand zu klären.
